Contract to Sell/Buy
The following agreement is between B&J's GDR hereafter
referred to as "Breeder" and , hereafter referred to as "Purchaser" for the sell and purchase of one purebred dog of the Great Dane Breed. In consideration of a purchase
price of $_______________________ which includes a two hundred dollar
non-refundable deposit, The breeder transfers in fee simple all rights,
privileges, and responsibilities associated with the ownership of a Male or
Female dog of the
Great Dane
breed to Purchaser as of the date and time
specified below. This represents the entire agreement between the Breeder and
the Purchaser in an (outright or Co-ownership) sale.
It is agreed between breeder and
purchaser that this dog is being acquired as a family companion dog or as a
working dog to be used for tasks appropriate to its breed such as herding,
search and rescue, therapy dog or for exhibition in AKC conformation, obedience,
or agility competition.
We agree that the dog
is not purchased for resale nor will it be used or trained for activities which
are illegal or for which it is not suited by reason of temperament or
conformation. Specifically, it will not be used as a guard or attack dog or to
hunt or fight other animals.
The breeder
warrants the dog to be in good health as of the time of sale. In the event of
any genetic disorder which is sufficiently serious and life threatening, in the
opinion of two qualified veterinarians, and all nutrition guidelines were
followed, the breeder agrees
* To Replace the
dog with one of equivalent quality from the same litter. If there are no puppies
available, one will be provided from the next available litter
whelped.
*This warranty is good for one full
year after purchase.
Breeder strongly
encourages purchaser to have the dog seen by a Veterinarian of purchaser’s
choice within 48 hours of picking up the dog. Said dog may be returned to the
breeder for any reason within the 48 hours following purchase, return shipping
cost will be the responsibility of the purchaser assuming the said puppy is not
returned due to health reasons. Replacement puppy will be made upon availability
and for the same value of the puppy listed above, only if all requirements
listed below are met.
*The dog/puppy is
declared to be in a life-threatening condition by a practicing licensed
veterinarian within 48 hours of the buyer obtaining physical possession of named
dog/puppy and a written report by the vet is submitted to seller. If the
dog/puppy dies within 48 hours, you must have followed the veterinarian’s advice
and have a necropsy performed (at buyers expense), by a state lab and provide
seller a copy of the report. There will be no cash refunds for any
reason.
The breeder certifies that the dog is
eligible for registration under the Regulations of the American Kennel Club as a
purebred Great Dane and will provide forms for such a registration. The breeder
reserves the right to affix the kennel names. “Kennel Prefix: and supply a
registry name for the dog.
The purchasher
agrees to maintain the dog in a humane environment and properly train and care
for it. Specifically, the dog will be properly licensed and Inoculated against
rabies, distemper, parvo virus, and other communicable diseases as recommended
by a qualified veterinarian. It is strongly recommended to keep your dog on year
round heartworm preventative.
Seller strongly
recommends that Buyer attend Obedience Classes with Puppy and provide proper
socialization opportunities for Puppy. Seller shall not be held responsible for
acts of Puppy, which are due to Buyer’s negligence. Seller also recommends a
form of positive identification, such as: Microchip or
tattoo.
Bitches that are purchased as family
companions and dogs that are judged not to be of show or breeding quality should
be spayed when they near maturity, or before twelve months of
age.
The breeders will use their best judgment
and the advice of other fanciers in evaluation the puppies as to show or pet
quality. The breeder reserves the right to sale a puppy with a restricted spay
or neutered clause. There is no guarantee that a puppy evaluated as “Show
Quality” will be successful in the show ring as an adult and no warranties are
made to that effect. No warranties are made on the size, temperament,
appearance, or breeding ability of said puppy at
maturity.
Seller does not guarantee against
hypoglycemia or any other common health issues such as diarrhea, wormy stool,
Coccidiosis, ear mites, external parasites, and stress due to shipping or new
environment. Puppies are susceptible to pneumonia and other infections due to
drafts, cold temperature, stress from shipping, etc, and are vulnerable to viral
infections including Parvo and Corona Virus. This warranty does not provide for
accidental death of this puppy. Nor does it cover minor conditions that are
common to the breed such as: ectropion, cherry eye, bloat (Gastric
Dilation-Volvulus), HOD, etc. Any and all above mentioned minor and/or major
health issues need to be examined by a licensed veterinarian if they occur, and
the advice of the veterinarian should be followed. Seller will not be
responsible for any accidents after seller gains physical possession of the
puppy/dog, regardless of method of shipping and/or pickup. All responsibilities
of the Seller of the dog/puppy are released at the time you pick up your
puppy.
Vaccinations: Complete all vaccinations.
Puppies should be vaccinated by 6, 9, 12, and 15-16 weeks of age, then at 6
months and 12 months, and every year after from their first birthday. Do not
expose your puppy to other dogs until a minimum of 4 vaccinations have been
received at 15 weeks of age. This includes trips to stores like Petsmart and dog
parks. It is advisable to not expose them to anyone who has dogs that are not
current on vaccinations. Certain diseases like Parvo can be carried on
shoes.
Follow the Breeders or Veterinarian’s
Advice on feeding and nutritional needs.
Please provide a safe and clean environment
for you Puppy. No pet is to be tied up on a chain or rope for any period of
time. If Pet is tied up for any period of time, Breeder has the right to remove
pet and take ownership. Great Danes are to be an indoor/outdoor pet. They are
not to be left outside in weather that is either too hot or too cold in
temperature.
In the event that the purchaser’s
are unable to keep the dog or provide an appropriate home in accordance with
this agreement, the dog
will be returned
to the breeder. Purchasers agree
to notify the breeder if any such contingency arises and will not abandon the
dog to a shelter or rescue.
There is no oral representation or warranties not contained herein.
This contract of sale contains the entire agreement between parties. All implied
guarantees are hereby excluded. This contract is legal and may be enforced by
legal means at the Buyer’s expense and all disputes must be settled in Yankton County, Yankton, South Dakota. This dog is sold to you as a pet only. Size, Color,
Quality, and Fertility is not guaranteed. By signing (including Esignature)
below, you agree that you have thoroughly read the entire contract and agree to
abide by it’s entirety. Everything listed and mentioned above in this contract
is legal and binding. The buyer has read and agrees to the above written
guarantee on the
